Luxeire LLC (referred to as “Luxeire,” “Company,” “us” or “we”) is committed to protecting the privacy of the users of its website (the “Site”). This policy discloses the Company’s privacy practices as they pertain to the Site and applies to information we collect when you interact with us online (e.g., through this Site or other online products and services) or offline (e.g., when you speak with customer support) or otherwise interact with us as described below. Our online and offline services and interactions with you are collectively referred to as “Services” in this policy. This purpose of this policy is to inform you (i) of the kinds of information the Company collects from users of the Site and how such information is collected; (ii) how this information is used by the Company; (iii) the security procedures that the Company uses to protect user information; and (iv) whether the Company discloses any user information to third parties.

By using the Site, you signify your assent to this policy. The Company reserves the right to change, modify, add or remove portions of this policy at any time. If any such changes, modifications, additions or removals are made, they will be posted on this page. Your continued use of the Site following the posting of any changes to the policy will mean you consent to and accept those changes.

Our products are also available for sale in several specialty stores and independent sellers. Data collected in these retail stores is the property of the stores and is not provided to Luxeire. If you have questions about retail store privacy policies, please contact the applicable store.

SECTION 1 – TYPES OF INFORMATION WE COLLECT

  1. Information we collect directly from you. We, or our service providers (e.g., such as Shopify, Inc.) on our behalf, collect information you provide directly to us. This refers to information that lets us know the specifics of who you are (“Personally Identifiable Information” or “PII”). We will collect PII when you (i) use this Site; (ii) provide product reviews; (iii) call us on the phone; (iv) create an online account; (vi) sign up to receive our emails; (vii) request a catalog; (viii) communicate with us via third-party social media sites; (ix) request customer support; or (x) otherwise communicate with us.

The types of PII we may collect include your name, email address, zip or postal code, billing address, shipping address, phone number, payment card information, product preferences, demographic information and any other identifying information you choose to provide. We may receive personal usage and demographic information from third parties we work with.

  1. Information we collect automatically. We automatically collect certain information about you when you access or use our Services. This information may include (i) information about your use of the Site, such as the type of browser you use, access times, pages viewed, your IP address and the referring link through which you accessed the Site; (ii) information about the device you use to access our online Services, including the hardware model and operating system and version; (iii) information about a purchase or return, such as product details and the date and location of purchase/return; and (iv) information about you when you interact with this Site, including information about your browsing and purchasing behavior. This information is collected in a variety of different ways, is compiled and analyzed on both a personal and an aggregated basis, and in a manner that may allow the Company or any affiliated entities to improve our services.

SECTION 2 – USE OF YOUR INFORMATION

The information that the Company collects is used for internal purposes in connection with the facilitation, recording and processing of any requests, communications or interactions you may have with the Site. Such information may be used to (i) provide, maintain and improve our Services, including to facilitate and improve your online shopping experiences; (ii) deliver the products and services you request, process transactions and send you related information, including confirmations and receipts; (iii) provide you with customer service; (iv) provide you with information and updates pertaining to your online profile, the Site’s Terms and Conditions, this Privacy Policy and any other Company news or updates; (v) detect, investigate and prevent fraudulent transactions and other illegal activities and protect our and others’ rights and properties; (vi) resolve disputes, diagnose problems with servers or software, and troubleshoot problems; (vii) measure the number of visits, average time spent on the Site, pages viewed and other such statistics pertaining to traffic on the Site; and (viii) personalize your online experience and provide advertisements, content or features that match your profile and interests.

SECTION 3 – SHARING OF INFORMATION

We will not sell, trade, or rent your PII to others. We may furnish third parties with data and statistics on an aggregate, non-personally identifiable basis. It is possible that a portion or all of our business may be sold. Customer information is generally one of the transferred assets. In the event that substantially all of the Company’s assets are acquired, your information may be transferred, subject to all applicable laws and governmental regulations regarding the transfer and sale of such data.

We do provide some of our product and service offerings through contractual arrangements made with affiliates, vendors, consultants, service providers, partners and other third parties (“Service Partners”).We and our Service Partners may need to use your personal information in order to perform tasks between our respective sites, or to deliver products or services to you. For example, we use the services of Google Analytics (http://www.google.com/analytics/) to help us measure the effectiveness of our advertising and how visitors use our Site. We will encourage our Service Partners to adopt and promote strong privacy policies. However, the use of your personal information by our Service Partners is governed by the respective privacy policies of those providers, and is not subject to our control. Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. Our Service Partners, have their own privacy policies and data collection, use and disclosure practices. We are not responsible for the policies or practices of third parties.

Occasionally we may be required by law enforcement or judicial authorities to provide PII to the appropriate governmental authorities. In such cases, we will disclose PII upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

SECTION 4 – LINKS TO OTHER SITES

This Site may contain links to sites other than our own. Those sites may have their own privacy policy, or no privacy policy at all. Neither we nor any of our Service Providers have any responsibility for those sites, and we provide these links solely for the convenience of our visitors. These sites may send their own cookies to you and may collect information and use it in a way inconsistent with this Privacy Policy. We encourage you to review the privacy policies and terms of use of any third-party sites or services before providing any of them with any of your PII. Neither Luxeire nor any of our Service Providers control the content that appears on these sites or take any responsibility for their content, nor should it be implied that Luxeire endorses or otherwise recommends such sites or their products or services offered. Once you leave this Site or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or this Site’s Terms and Conditions.

SECTION 5 – SHOPIFY

We use a third party server to host this Site called Shopify Inc., the privacy policy of which is available here https://www.shopify.com/legal/privacy. Shopify provides us with the online e-commerce platform that allows us to sell our products to you. This Site server automatically logs the IP address you use to access this Site as well as other information about your visit such as the pages accessed, information requested, the date and time of the request, the source of your access to this Site (e.g., the website or URL (link) which referred you to this Site), and your browser version and operating system. Shopify will store the personal information you submit to us on its servers in the US or Canada.

After you place an order on this Site you will need to make payment for the goods or services you have ordered. In order to process your payment we use a third party payment processor (Shopify Payments). Shopify Payments collects, uses and processes your information, including credit card information, in accordance with Shopify’s privacy policies. Your purchase transaction data will be encrypted through the Payment Card Industry Data Security Standard (PCI-DSS) and is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, and American Express. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its Service Providers.

SECTION 6 – ADVERTISTING AND OTHER TRACKING TECHNOLOGIES

We engage third parties to serve advertisements on our behalf across the Internet and to provide analytics services. These entities may use cookies, web beacons and other technologies to collect information about your use of this Site, such as your IP address, web browser, pages viewed, time spent on pages, links clicked and conversion information. This information may be used by us and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on this Site and other websites and better understand your online activity. 

We may also work with third parties to serve ads to you as part of a customized campaign on other websites or platforms. SECTION 7 – SECURITY AND DATA RENTENTION

Your PII is stored through Shopify’s data storage, databases and the general Shopify application. To the extent we store any of your PII, you can be assured that your PII is secure, consistent with current industry standards. We strive to take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of PII. For example:

  • We only keep collected information and use it only for the purposes for which it was collected or to comply with any applicable legal or ethical reporting or document retention
  • We limit access to PII only to specific employees, contractors and agents who have a reasonable need to come into contact with your information.
  • We employ a number of physical, electronic, and procedural safeguards to protect PII. Our secure servers and our data centers are protected by industry-standard encryption, and our servers reside behind firewalls and employ high-level password protection.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect PII, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this Site cannot be guaranteed.

We do not collect, access, store or process any credit card information. Please read the privacy policy on Shopify’s, our payment processor’s, website regarding the use, storage and protection of your credit card information before submitting any credit card information. However, to the extent you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. We follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Our retention periods for personal data are based on business needs and legal requirements. We retain personal data for as long as is necessary for the processing purpose(s) for which the data was collected and any other permissible, related purpose. For example, we may retain certain transaction details and correspondence until the time limit for claims arising from the transaction has expired.

SECTION 8 – COOKIES

This Site uses cookies and similar technologies. A cookie is a small data text file which is stored on your computer that uniquely identifies your browser. Cookies allow websites to recognize you when you return and are able to keep track of information specific to your site visits. Cookies may also include more personalized information, such as your IP address, browser type, the server your computer is logged onto, and the area code and zip code associated with your computer. They may be served by the entity that operates the website you are visiting (“first-party cookies”) or by other companies (“third-party cookies”).

We may store cookies on your computer in order to collect certain aggregate data about you. The Company does not control these third party cookies and they are not subject to this privacy policy.

The types of cookies we use typically fall into one of the following categories:

  • Strictly necessary cookies. These are cookies that are required for the operation of our website. They include, for example, cookies that enable you to log into secure areas of our website, use a shopping cart or make use of e-billing services.
  • Analytical/performance cookies. They allow us to recognise and count the number of visitors and to see how visitors move around our website when they are using it. This helps us to improve the way our website works, for example, by ensuring that users are finding what they are looking for easily.
  • Functionality cookies. These are used to recognise you when you return to our website. This enables us to personalise our content for you, greet you by name and remember your preferences (for example, your choice of language or region).
  • Targeting cookies. These cookies record your visit to our website, the pages you have visited and the links you have followed. We will use this information to make our website and the advertising displayed on it more relevant to your interests. We may also share this information with third parties for this purpose.

We may also use a pixel tag, also known as a clear GIF or web beacon, which is an invisible tag placed on certain pages of our Site but not on your computer. When you access our pages, pixel tags generate a generic notice of that visit. They usually work in conjunction with cookies, registering when a particular computer visits a particular page. If you turn off cookies the pixel tag will simply detect an anonymous website visit.

You may control or limit how we and our partners use cookies and similar technologies, including, but not limited to, by (i) deleting or blocking the cookies, but if you do, some of the features on the site may not work as intended; (ii) clearing or declining cookies from your browser; or (iii) installing Google’s opt-out browser add-on to prevent your data from being used by Google Analytics.

In order for you to use our Site, it is necessary that you have consented to the use and processing of your information. This consent is captured when you set your privacy setting on your browser or when you acknowledge the notification that is sent to you. By using this Site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

SECTION 10 – CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on this Site. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

SECTION 11 – CALIFORNIA RESIDENTS

California law permits residents of California to request notice of how their information is shared with third parties for direct marketing purposes. PROVISIONS THAT APPLY WHEN INDIVIDUALS ARE BASED IN THE EUROPEAN UNION AND/OR THE UK.

These conditions are supplemental to the terms set out above and apply where individuals are located in the EU and /or UK.

Data Protection Legislation means the General Data Protection Regulation ((EU) 2016/679), the UK Data Protection Legislation and any other directly applicable European Union regulation relating to privacy.

 UK Data Protection Legislation means any data protection legislation from time to time in force in the UK including the Data Protection Act 1998 or 2018 or any successor legislation.

Applicable Laws means (for so long as and to the extent that they apply to the provider) the law of the European Union, the law of any member state of the European Union and/or UK Law;

  1. Processing: Our Third-Party Data Processors (service providers such as hosting providers, data storage providers, and other technical partners) who help us administer this Site, or process the Personal Data submitted to it, may have access to your Personal Data.

Personal Data: The Data Protection Legislation extends the definition of PII (as outlined above) to include any information by which an individual can be identified and includes location data and online identifiers. Each reference in this policy to PII shall be taken to refer to Personal Data as defined in The Data Protection Legislation where the individual is in the EU.
  3. Consent: In order for you to use this Site, it is necessary that you have consented to the use and processing of your Personal Data. This consent is captured when you set your privacy setting on your browser or when you acknowledge the notification that is sent to you. You may opt out or withdraw your consent by using your browser to block cookies.
  4. Children: EU guidelines provide that children under 13 years old cannot consent to the use of their Personal Data. Accordingly we do not collect Personal Data from children under the age of 13, and we do not create or use or collect identifiers that may be used to identify children under 13 years of age.
  5. Transfer Outside the EEA: In order to provide you with the services we offer on this Site, it is possible that Personal Data collected from you will be transferred to and stored by us or our suppliers outside the EEA. Whenever we transfer your Personal Data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:
  • We will only transfer your Personal Data to countries that have been deemed to provide an adequate level of protection for Personal Data by the European Commission.
  • Where we use certain service providers, we may use specific contracts approved by the European Commission which give Personal Data the same protection it has in Europe.
  • Where we use providers based in the US, we may transfer Personal Data to them if they are part of the Privacy Shield which requires them to provide similar protection to Personal Data shared between the Europe and the US.
